1. Terms & Conditions

These Terms & Conditions govern the use of the Hotel By Now website, platform, and related services. By accessing the website or making a reservation through Hotel by Now, users acknowledge that they have read, understood, and accepted these terms.

Hotel by Now operates as a tourism and travel services brand powered by Snow Evolution, SLU and Holidays Andorra GC, SL, together with selected third-party suppliers and tourism partners. The booking pltaform is powered by Travel & Night SL.

These terms apply to all users, visitors, and customers using the website, requesting information, or booking any service promoted through the Hotel By Now platform.

2. Booking Conditions

2.1 Booking Process

Reservations may be made through the Hotel by Now website, partner platforms, or direct communication channels including email, messaging services, or travel advisors.

Bookings become confirmed only once the following conditions have been fulfilled:

• Availability of the requested service is verified.
• Payment requirements or deposit conditions are fulfilled.
• A booking confirmation document is issued.

2.2 Payment Schedule

Depending on supplier requirements and booking conditions, reservations may require either a deposit payment or full prepayment at the moment of confirmation.

In certain cases, and subject to approval, Hotel By Now may allow a flexible payment plan adapted to the customer's possibilities. Selected bookings may also be confirmed in advance while payment is completed progressively after confirmation.

In all situations, the total amount must be fully paid no later than the day of arrival or before the start date of the booked service.

2.3 Changes to Bookings

Modification requests are subject to availability and may involve additional costs imposed by service providers, accommodation partners, transport operators, or other suppliers.

3. Cancellation & Refund Policy

3.1 Supplier Conditions

Cancellation and refund conditions depend primarily on the policies of the service provider, hotel, airline, transfer company, activity operator, or other supplier involved in the booking.

Most travel services offered through Hotel By Now are provided by independent suppliers such as:

• hotels
• airlines
• transport operators
• experience providers

Cancellation conditions are determined primarily by the respective service provider.

3.2 Refund Eligibility

Refunds, when applicable, depend on the supplier's policies and the type of booking.

Some rates may be non-refundable.

3.3 Processing Refunds

Where refunds are approved, Hotel by Now will process them according to supplier authorization and payment provider timelines.

3.4 No-Show

Failure to attend a booked service without prior cancellation may result in the booking being considered a no-show, with no refund granted.

4. Payment Terms

4.1 Accepted Payment Methods

Payments for services booked through Hotel by Now may be made using the payment methods made available at the time of booking, including card payments, bank transfers, secure payment gateways, or other approved digital payment systems.

4.2 Deposit and Balance Payments

Depending on the booking type, supplier conditions, travel dates, or rate selected, customers may be required to pay either a deposit at the time of confirmation or the full amount in advance.

In certain cases, and subject to approval, Hotel by Now may allow a flexible payment plan adapted to the customer's possibilities.

Selected bookings may also be confirmed in advance while payment is completed progressively after confirmation, provided that the full balance is paid no later than the day of arrival or the start date of the booked service.

Any flexible arrangement remains at the sole discretion of Hotel By Now and may depend on supplier requirements, booking value, seasonality, destination, and operational feasibility.

If payment is not received within the established time limits, the reservation may be cancelled automatically and availability or pricing may no longer be guaranteed.

4.3 Currency

All prices are generally displayed in Euro (€) unless otherwise stated. Currency conversion charges may apply depending on the payment provider.

5. Liability Disclaimer

Hotel by Now, Snow Evolution, SLU, and Holidays Andorra GC, SL act as travel organizers, intermediaries, facilitators, or resellers depending on the specific service booked. Travel & Night SL atcs as booking platform technology provider.

Many services promoted through the platform are provided by independent third-party suppliers, including but not limited to hotels, airlines, transportation companies, ski resorts, activity operators, local guides, and tourism service providers.

Each third-party provider remains solely responsible for the execution, safety, legality, and quality of the services it delivers.

To the maximum extent permitted by applicable law, Hotel By Now and its operating companies shall not be held liable for cancellations, delays, overbookings, supplier insolvency, weather disruptions, force majeure events, strikes, border restrictions, operational failures, or any direct or indirect damages caused by third-party providers.

Customers acknowledge that travel services may involve risks outside the control of Hotel By Now and agree that liability, where applicable, shall always be limited to the amount effectively paid for the affected service, except where mandatory law provides otherwise.

6. Legal Entities, Licensing & Insurance

Depending on the service booked, the contractual relationship may be established with Snow Evolution, SLU, Holidays Andorra GC, SL, or directly with the third-party provider responsible for the execution of the service.

7. Jurisdiction & Disputes

These Terms & Conditions, and any contractual relationship arising from the use of the Hotel By Now platform or from any booking made through it, shall be governed by the laws of the Principality of Andorra.

In the event of any dispute, claim, or disagreement, the parties agree to first seek an amicable solution in good faith before initiating legal proceedings.

If no amicable resolution is reached, any dispute shall be submitted to the competent courts of the Principality of Andorra, except where mandatory consumer protection laws provide otherwise.

8. Privacy Policy & Data Protection

Hotel By Now respects the privacy of its users and is committed to processing personal data responsibly and in accordance with applicable data protection regulations, including the GDPR where applicable.

Personal data may be collected and processed for purposes including booking management, customer communication, service coordination, invoicing, payment handling, fraud prevention, legal compliance, and the delivery of tourism services.

Data may be shared only with the operating companies, relevant hotels, airlines, transfer providers, activity operators, payment processors, or other suppliers strictly necessary to perform the requested service.

Customers may request access, correction, or deletion of their personal data where legally applicable. Such requests may be sent through the official contact channels of Hotel By Now.

Personal data will be stored only for the time necessary to fulfill the contractual, operational, fiscal, and legal obligations associated with the services provided.

9. Website Use & Intellectual Property

All content displayed on the Hotel By Now website, including but not limited to text, design, layout, logos, branding, graphics, images, videos, source code, and digital assets, is the property of Hotel By Now, its operating companies, or its licensors and partners.

Users may not reproduce, republish, distribute, modify, scrape, copy, exploit, or use any website content for commercial purposes without prior written authorization.

The website may not be used for fraudulent reservations, unlawful activities, abusive behavior, attempts to disrupt service, or any use that may damage the reputation, systems, or commercial interests of Hotel By Now or its partners.

Hotel By Now reserves the right to suspend or restrict access to any user who misuses the platform or breaches these terms.
